downloadAs a part of Annual Filing, Companies incorporated under the Companies Act 1956 or Companies Act 2013, are required to file the following E-Forms with the Registrar of Companies (ROC):-

Form 23AC : For filing Balance Sheet (applicable to all Companies other than select class of Companies)

Form 23ACA : For filing Profit & Loss Account (applicable to all Companies other than select class of Companies)

Form 23AC-XBRL : For filing Balance Sheet in XBRL format (applicable to select class of Companies)

Form 23ACA-XBRL : For filing Profit & Loss Account (applicable to select class of Companies)

Form 20B : For filing Annual Return by Companies having share capital

Form 66 : For filing Compliance Certificate by Companies having paid up capital of Rs. 10 lakh – Rs. 2 crore

Form 21 A : For filing Annual Return by Companies not having share capital

Form AOC-4 : For filing financial statement and other documents (For FY start on or after 01.04.2014)

Form AOC4-CFS : Form for filing statement containing salient features of consolidated financial statement of a group (For FY start on or after 01.04.2014)

Form AOC4-XBRL : For filing XBRL document in respect of financial statement and other documents (For FY start on or after 01.04.2014)

Form MGT-7 : Form for filing Annual Return by Companies having share capital (For FY ending on or after 01.04.2014)

VPP Scam – Company Registration & DIN Allotment

Image result for scamHello everyone, Trust all of you doing extremely well in your life. Today I would like to inform you about VPP scam. The VPP scam is now common for all young or new entrepreneurs.  

Story – When you registered a company or just applied for DIN and there comes a postman with VPP parcel, that seems to be sent through Ministry of Corporate Affairs (MCA), at your door steps and asks for Rs 1900 for delivering the packet as it is Value Payable Post. You in joy, that you have received the certificates from MCA after application of Company Registration in India, gives Rs 1900 to the post man and receives the packet. Now you are enthusiastically opening the packet. Bingo there is the Scam !! The VPP Scam !!

Why this is scam – This is scam because we purchased useless material and paid Rs 1900/-. We think that Ministry of Corporate Affairs (MCA) sent parcel to us and it is very important for us but truth is opposite. Its a scam. 

Various fraud companies including certain publishing houses, extract this information of such newly registered company from MCA. They send various books, journals, copy of registration certificate or may be some useless papers etc. to the newly registered addresses of new companies through VPP i.e. they instruct the Posts to get the charge while delivering the item like COD (Cash on Delivery).

When it started – As per our analysis this scam started since 2011. 

Reason – The entrepreneurs who want to get their Company/LLP registered provide all their information to the Ministry of Corporate Affairs. Now, this information gets public and all details are available to the people about the new companies being registered.

Solution 

  • Share this post on social media because your small efforts may enhance knowledge of young and new entrepreneur reading this scam.
  • Inform to your family members that you not order any parcel and not pay any amount before your confirmation. 
  • If by mistake you paid then raise a complaint against such publication house and aware to your circle about such scam.

MCA Updats – 09.05.2017

  • MCA – Due to urgent maintenance the following document related services will not be available on Tuesday, 9th May 2017 – View Public Documents, Download of form 49A/49B, Download form for Resubmission, and Documents in Track Payment Status / Track SRN status / Enquire DIN status services. Stakeholders are requested to plan accordingly.
  • Form DIR-3C and RD-1 are likely to be revised on MCA21 Company Forms Download page w.e.f 11th May 2017. Stakeholders are advised to check the latest version before filing.
  • Forms CHG-1, CHG-4, CHG-9 and STK-2 were recently revised on MCA21 Company Forms Download page. Stakeholders are advised to check the latest version before filing.

MCA Upload Defaulting Status of All Companies..!!

Image result for mca master dataMCA has updated all the master data by adding defaulting status. If any company is in default for annual filing for the year 2015-16 than MCA mark it as a defaulting.

Example – “Default Status – Defaulting in filing of Annual Return and Balance Sheet for the financial year 2015 – 2016”

8-9 Lakh Registered Companies Not Filing Returns

Close to 9 lakh registered companies are not filing annual returns with the Ministry of Corporate Affairs (MCA) and are a potential source of money laundering, Revenue Secretary Hasmukh Adhia said today.

Image result for ministry of corporate affairsThe MCA has sent notices to nearly 3 lakh unlisted companies asking them to deregister themselves and issuance of notices to the remaining is under way. Speaking at the Enforcement Day event here, Adhia said out of the 15 lakh companies, only 6 lakh are filing their returns, including annual audited report, with the MCA. “How can we have in this country almost 8-9 lakh companies which are not filing any return to the government and they have become a potential threat, a potential source of money laundering. So, the task force has taken it up in right earnest,” he said.

Image result for Income TaxIn a major crackdown on domestic shell companies, the government in February had decided to take “harsh punitive” action, including freezing of their bank accounts used to launder money or evade taxes. The task force set up with members from regulatory ministries and enforcement agencies held its meeting this week. “After registering (with the MCA), if companies do not file their return to the MCA, then there is no reason for us to let such companies operate in India. They become a potential threat. That is one strategy that we are working on,” Adhia said.

The top official said all of the 9 lakh companies which do not file return with the MCA might not be shell companies and just be idle ones not transacting any business. As per the income tax department records, out of the 15 lakh companies registered in India, only 6 lakh file returns. Out of these 6 lakh, about 3 lakh show nil income.

Aadhaar is mandatory for all stakeholders – MCA

Image result for aadhaarMCA is actively considering Aadhaar Integration for availing various MCA21 related services. As a preparatory step, all individual stakeholders viz. DIN holders /Directors/ Key Managerial Personnel/ Professionals of the Institute of Company Secretaries of India-Institute of Chartered Accountants of India-Institute of Cost Accountants of India (whether in employment or in practice) are requested to obtain Aadhaar as early as possible for integrating their details with MCA21 and also ensure that the information in Aadhaar is in harmony with PAN. When implemented, all MCA21 services shall be available based on Aadhaar based authentication ONLY. The date of Aadhaar integration with MCA21 would be announced shortly. Stakeholders are requested to plan accordingly on PRIORITY so as to avoid future inconvenience.
